The 340B Program: New Developments and New Opportunities for CAHs and Others - Todd Nova, Associate, Hall, Render, Killian, Heath & Lyman. The expansion of 340B Drug Discount Program eligibility to Critical Access Hospitals under the Affordable Care Act was welcomed with open arms.  New opportunities nonetheless present unique implementation challenges.  This presentation will address 340B Program participation requirements applicable to CAHs (including provider-based considerations).  We will also discuss new developments such as the proposed rules addressing the orphan drug exclusion, manufacturer compliance with 340B Program discount mandates, and dispute resolution processes related to complaints against manufacturers for failures to provide required 340B Program discounts.
